These Terms of Service apply to the website rizocreativo.com and to photography, video and related services provided by Rizo Creativo, LLC, a Minnesota limited liability company based in Minneapolis, Minnesota (“Rizo Creativo,” “we,” “us”). By booking a session or using this website you agree to these terms. Your signed contract or written quote, if any, controls where it differs from this page.
1. Services and booking
Packages, prices and what is included are described on our Services page and confirmed in your quote. A date is reserved only after we confirm availability and receive the deposit. A 50% deposit reserves your date, and the remaining balance is due as stated in your quote or contract.
2. Cancellation and refunds
Cancellations, rescheduling and refunds are governed by our Cancellation and Refund Policy, which is part of these terms.
3. Delivery
We offer a preview gallery within 48 hours of the session. The final gallery follows within the estimated time shown for your package, counted from the day you choose your favorites. Delivery times are estimates, not guarantees, and may vary with the services you book, the season and the size of the shoot. Galleries are delivered online with high-resolution downloads.
4. Copyright and license
Rizo Creativo retains the copyright to all photographs and videos. All rights are reserved. Every package includes a personal print release, which lets you print and share the images for personal, non-commercial use. Commercial use, advertising, resale, or use by third parties requires a written license. Corporate packages include a web and social license as described in your quote. Please do not remove watermarks or credits, and do not apply filters that alter the images in a way that misrepresents the work when sharing them publicly.
5. Portfolio and promotion
We may use images from your session in our portfolio, website and social channels. If you prefer that your images are not used, tell us before the session or in writing, and we will respect it. Sports and event photographs of minors are used only with a parent or guardian’s consent.
6. Your responsibilities
You agree to provide accurate details about the date, place and schedule, to arrange access to the venue and any needed permissions, and to inform the people being photographed that the session will take place. For events, you are responsible for any venue rules that limit photography.
7. Limits of liability
We work with care and professional equipment, but photography depends on conditions we do not control, such as weather, light, venue rules and the cooperation of the people photographed. If we cannot deliver the service because of illness, equipment failure or events beyond our control, we will offer a reschedule or a refund of the amounts paid for the undelivered service. Except where the law does not allow it, our total liability is limited to the amount you paid for the affected service, and we are not liable for indirect or consequential losses.
8. Website use
The content of this website, including photographs, text and design, is protected by copyright and may not be copied, scraped or reused without written permission. Our Privacy Policy explains how we handle your information.
9. Governing law
These terms are governed by the laws of the State of Minnesota. Any dispute will be handled in the state or federal courts located in Hennepin County, Minnesota, unless the law requires otherwise.
